Anyone who set up a totally hedged long conversion on Qualcomm (long put, short call, long stock) -- could now simply sell their (long) stock right now, and effectively become short.

In other words -- you are mistaken.

Depends on the broker, some allow SS (Datek, for one), some don't. I'm sure the big $ players can short if they want.

Actually it is better than that... no uptick is required to short NASDAQ stocks on instinet (depending on the broker).
