Let me first commend your efforts here, not only for your DD & exposition of TERN's SEC filings, but also for carrying on an interesting & important debate that IMHO is long overdue.

Now, with that said, allow me to join in . . . What you have accomplished here, Pat, is to provide facts relating to TERN's business model & have left to the individual reader the ability or propensity to come to one's own conclusions. You have not wrongly "accused" TERN of concocting a scam, or more appropriately a "fraud upon the market."

For apparent reasons Mr. Anderson is not comfortable with the information you have provided here & appears to have come to the more logical conclusion regarding the facts, but the wrong conclusion regarding intent. May I suggest to Mr. Anderson that if he is not comfortable with the information being "exposed" here, that he reevaluate his investment in TERN. It is that simple.

If I were Mr. Anderson, I would be thanking you for highlighting the facts that you have here. As an investor I am ALWAYS interested in learning more about where my money is invested & leave to my own faculties the abilit to draw conclusions as to whether that investment remains appropriate. Mr. Anderson should do the same.

Now, I've thrown some challenges your way: A comparison of TERN's modems with CMTO's; an analysis of the write-off for cost of warrants; a rebuttal to the DOCSIS 1.2 issue, specifically TERN's plan if S-CDMA doesn't become a core part of the standard; and finally how they plan to compete without a major US customer

I acknowledge all of these risk factors associated with TERN. Do you really think you are the only one who is aware of these issues? The market is aware of these issues and has placed a significantly higher value on TERN than CMTO. The market is telling you that there is a higher probability that TERN will be successful than CMTO. If you want to ignore what the market is telling you, be my guest.

It seems like you would rather be right than make money. Because I own both CMTO and TERN, I'll make money regardless of how the risk factors resolve. If you're wrong, well too bad. My strategy has been superior so far.

If you're comments regarding TERN are motivated by a desire to help CMTO shareholders understand their investment, then I commend your efforts. However, when you start making allegations against TERN that essentially amount to charges of fraud, and quote anonymous inside sources to support this accusation, I think folks should consider the possibility that you have other motives and corroborate what you have to say.

I think we've beaten this horse enough.
