Do you think Go2Net could get an injunction to stop me if I were to clone the SI database and provide it over an ordinary telephone provided the client could demonstrate he was already a SI subscriber?

I think RIAA has a pretty good shot at a preliminary injunction to stop the Beam-It service, but Instant Listening should be okay. The really interesting question is whether damages might apply. The RIAA is asking for statutory damages at $150,000 per "work". Assuming 45,000 CDs copied at 10 songs each, that's $6.7 billion. Of course, such damages are usually reserved for cases of deliberate and willful infringement of copyright.

We shall see...
