Not only does it label them as such if they engage in such behavior within a 5 day period, but labels them as such immediately IF they have been specially trained or otherwise indicate their intention to engage in daytrading -before a single trade is executed.

Nonetheless, I'm still pretty sure that a grandfather clause or some other concession will be offered. Not that such is any saving grace, mind you; it could still be onerous, requiring a ridiculously long previous history of daytrading or specifying some other, unrealistic behavioral pattern...

All in all, not too great for firms that rely on customers or public customers who daytrade. Then again, with some of the snake oil salesmen hovering around the periphery of the industry that there are; and, with the constantly erroneous media coverage, it was only a matter of time before the regulators set upon the one area they could easily and quickly impact in one fell swoop - the firms and traders themselves.
