NextWave previously announced it would commence operations in 40 cities for fixed wireless internet, and had contracted with some vendor, whose name I cannot recall. When we checked the vendor, it does not say it is IS-95, so it looked as if it will be non-Qualcomm. Although it will be a form of cdma, it is not clear it will be in the "cdma camp."

When LWIN announced it favored re-auction, it made it plain that only the qualified companies would be permitted to bid and I believe also that LWIN made its announcement before it was clear that the FCC was not going to try to sell to Nextel in the "setup" deal. Many interpreted LWIN's announcement as attempting to actually help NextWave by making it clear to the FCC that it could not do an end run around C-block qualified as it appeared FCC might attempt to do.

Nextwave has always been a staunch supporter of CDMA.Salmasi has always been an innovator and His routes are in QUALCOMM and His routes are deep into QUALCOMM more then most people realize.He was behind QUALCOMM's Omnitracts product which of course became widely used worldwide and still comands that market.I belive they are leaning towards HDR or 3G fixed and mobile IMOH.This is largley due to the belief they could leapfrog and grab market share before others get really entrenched with high speed CDMA data networks.

The court decision rules out the acquisition of NextWave spectrum by NexTel. This at least is positive. As to whether this means a CDMA network for NextWave, it's not clear from any of the info I've seen. However, the market itself may take care of that issue, since CDMA is clearly the technology of choice, especially when there is a need for wireless data access.
