Exactly!! The obvious answer is if you sell at Brown, the shares held in that account are the ones you sold.

If you hold shares at ETrade and Brown, and you sold at Brown, then to identify the sold shares as the ETrade shares you would have to effect a transfer of stock from ETrade to Brown. In order to NOT sell the Brown shares from the Brown account, you would have to sell short against the box in the Brown account, so you would not be selling either of the lots you own. To close the short, you could deliver the shares from ETrade to offset the short, but you would have to identify the shares at the time, so all identity questions would be answered.

If you did the transfer before the sale, then the oldest shares would be sold first (FIFO), but that's no longer the issue in question.

Yes that was the question.

I also don't see how it could be any answer that you sold the shares held at Brown. I just thought it might be a way to put an end to all this worry over FIFO sales on stocks positions held both long term and traded. Because in todays strange market a long term holder is really shortchanging themselves if they don't take advantage of some of these prices changes from month to month.

I think the whole theory could be easily defended. But I do not know if there have been any prior rulings on this sort of thing.

Can I still open up an IRA in another institution and contribute to it.
