FNS, I totally 100% DISAGREE with your above statements. COMS is spinning off Palm, simple as that. No conspiracy theory should be read into it. A successful ipo benefits ALL coms shareholders of which EB, the executive team and the BOD are the major ones. Even the coms' janitor will be laughing to the bank !

The clause about coms having the right to not distribut the shares are for :

1. to ensure a tax free distribution to us - do you want to pay Uncle Sam the full amount of tax on the Palm gain - right after Feb. 00 ???

2. coms is leaving the way for another company to jump in after IPO to buyout coms and pockets the 80% Palm if the company is willing to pay a premium over and above "1.5 Palm / coms" combined value.

numbers numbers, help out please :

Assume at the time of spin off, COMS hits $100 and PALM then, say, $70, what price will COMS drop to once spin off is recorded ? Is this a must thing according to the mathematical rules or depends on the market reactions ?

great read, but i don't share it. here's why. credibility. if benhamou really is righting the COMS ship, he must know that there is damage control to be done in the credibility department. and a move such as the one you've outlined would propel benhamou so far back into the wasteland of broken promises and missed opportunities that nothing could ever be salvaged.

of course, as dennis miller would say, that's just my opinion, i could be wrong!

First let me go on record as saying that I think you're absolutely right... about..

is viewed as a sinking ship, Palm stays on board! When COMS can fly SOLO, PALM shares will be distributed and BOTH PALM and COMS will fly!


The only thing I'd add is that if EB can't get the COMS business off the ground that the PALM holding makes a purchase more attractive. And if COMS is purchased the suitor may indeed not want to let the PALM shares go. He protects that possibility as well.

Second... on a TA note. Did you notice all the air under this pup. No support all the way to 46. 45 (which I don't expect us to see again would be a very bad sign... but either way there's lots of room to move around between here and there. COMS needs to work a base in here. A pull back to 54 would be very healthy.
