i don't think they were "merely" thinking about it applying (although that's the impression one gets when reading their 10qs); they began testing broadband CDMA for application to mobile environments. this was stated by an IDC engineer at a meeting in '98. i don't think he had any reason to lie (other than a $5 stock price). a month later i asked IDC's management to confirm this information and they had "no comment" other than to positively confirm that bcdma already contianed all the hooks for mobility. accordingly, they were fairly along in the process then. while ERICY was making announcements about testing, IDC was working out the bugs. many knew by '98 that the wll environment would be combined with the mobile environment anyway; at least this was beginning to form a part of the Satellite/Terrestial (separate) 3g ITU platform.

so, i think IDC management is purposefully being quiet about all that's going on. it's only been in the last month that they've began speaking out; the picture is clearer - patents have been declared essential, agreements are being forged.
