Here, the dumb thing is that the nasdaq goes backwards. They think about introducing the short sale rule on Snet off-market. Would be interesting whether the brokers can handle that, fragmented as the market is. Who would prevent you from hitting a (downticked) ISLD or REDI bid? The ECNs currently can't measure the ticks, and then no broker gathers the particular bids and asks off market (especially aftermarket) then he can't do it either. There are no consolidated quotes.

On the other hand the OBB and the Naz SmallCap market don't know the uptick rule at all?
