Tom, I used to bring age discrimination cases . . . . and my ex-wife is a pro at defending them for one of the nation's top labor defense firms here in Chicago. Some thoughts: 1) You are right on the money regarding the plaintiffs' weak hiring of counsel 2) These cases are virtually impossible to prove, particularly on a "class" basis 3) QCOM will undoubtedly have top-notch defense counsel 4) The case will be buried in federal court for well over a year and, in all likelihood, we will next hear of it, if we hear of it again, ever, regarding a piddly out-of-court settlement 5) The Kyocera layoffs were much more significant from a financial standpoint Trust me.
