you cannot re-enter the same position (stock) within 30 days or it is a "wash sale."

Oh, you can re-enter all right (there's no revenuer to stop you at the trading desk). You just can't take a capital loss if you re-enter the same position. The IRS will not complain if you take a capital gain.
