Not exactly the modus operandi at the "patent departments" of large corporate entities. The lawsuit was brought for reasons for some reason - its timing is a bit bizzaro though. One defense IFMX's counsel may be looking at is "laches" - being aware of the infringing activity and not choosing to assert your rights until a passage of "some" time. Sort of analogous to squaters rights, except this is an equitable defense. I am unfamiliar with the patents at issue - anyone know which ones are being asserted - or the age of the products in question - feel free to post them - but this would be my first examination. Of couse, the validity of such patents may also be worth taking a peak at, as well as a bunch of other things. Bottom line: I am long on IFMX, and while patent disputes sometimes sway given my professional leanings, this is not one I suspect that will cause me to rethink the matter. I would advise threadsters not to get to caught up in the negativity of the matter as it isn't worth raising your blood pressure. If you invested in IFMX for a reason other than them being a defendant in a patent lawsuit brought by IBM, I wouldn't think this should change your focus. Just MHO. Would be interested in what info we can digest though....all should feel free to post patent numbers, etc., and perhaps we can discuss it in an objective context.
