The cc was yesterday and price is down perhaps $5 from that level. May not provide sufficient damages for lawsuit. Also talking to analysts rather than putting out a press release has been the way investors have been informed in the past so it is not a deviation from accepted procedure. The bloom is off the rose. But there is still money to be made here on the long side I believe.
