The 4x is part of this proposed rule change. It's up to the broker wether buying power applies to the total purchases for each day, or to the largest open position of the day in a margin account.

As for grandfathering existing accounts, I wouldn't bet on it. I have a feeling that a primary motivation for the rule change is to reduce the number of trades that must be handled by the Nasdaq system. We all know they cannot keep up with it now (the late data in the morning syndrome). What better way to reduce the load than to protect the small investor from himself by taking away his trading privileges.
