German courts are civil law courts, not common law courts. The finders of fact are judges, not juries. If the finder of fact (judge or jury) isn't technically informed, I'd suggest that the fault lies with the litigants. The lawyers didn't do a good job, the expert witnesses didn't do a good job, but the blame lies on the corporate honchos who didn't make sure that the expert witnesses and lawyers were adequately prepped. If the technology can only be understood by engineers, going to court is just a crapshoot.
