Perhaps you are referring to the German practice of using laymen as part of the panel of jurists in limited circumstances, like tax courts. Otherwise, I am fairly certain that only jurists are used as the triers of fact in Germany. I much prefer the practice of using arbitrators who are trained in the field, as we do here in the US for securities cases, and construction cases, for example. I think patent disputes would far better be served if the triers of fact were trained arbitrators with professional expertise in the field at issue.
