If the Rogers waiver were settled, TERN would be able to recognize the revenues in question --- a material change that would require public disclosure. What are the chances of leaving out such favorable information?

On the other hand, if there were developments regarding Rogers they didn't want made public, any mention would require a full disclosure. By leaving the paragraph out --- and cautioning investors to read other filings --- they escape any chance of partial disclosure.

I've left a message with my attorney and once I get a professional opinion I'll let you know.
