Yes, I see. The legal standard involves unfair suppression of competition, not mere percentage of market share. The merger certainly prevents no company from entering the competition. Someone I know, who worked in upper level management for Anheuser-Busch, told me that the company worried that if it were to capture more than the ~50% of the U.S. beer market it had already captured, the Justice Department might come looking. Certainly JDSU-ETEK will be the Anheuser-Busch of fiberoptic components, in a nation of fiberoptoholics.
