Cyrus, In general the Fed have to respond to the merger request no later than 30 days after the filing date. Now, merger was announced on Jan. 18th, assuming that the filing was done at or few days before/after, that puts us very near the due date. However, Fed could always ask for additional info, but I really doubt that, especially with the recent mergers and buy-out in the optical arena.

That is exactly what JDSU stated in their press conference after the announcement of the ETEK acquisition.
The thing they refused to disclose was the actual date that they made the filing. They were actually questioned on the date but they declined to answer that question. The reason for not answering that question could be to avoid market speculation. They may have actually waited until they prepared their "case" fully before filing.

The day it gets approved, you will see ETEK stock price going up significantly. I remember that one day I saw OCLI price discount almost disappear and concluded that it was because regulatory clearance was received for the deal.
