Ahah! Maybe this is the infamous "opinion" mentioned in my prior post. Looks like Lexar saying: Oh gee, we didn't willfully infringe. Our high paid law firm told us we weren't and we're gonna blame it on them if we did."

Query 1: So why doesn't Lexar want to let SanDisk see the"opinion" letter?

Answer: The "opinion" letter wasn't so clear cut on the issue of infringement.(IMHO)

Query 2: Why didn't Lexar want to reveal who had "read" and/or "reviewed" the "opinion"?

Answer: If the answer to query 1 is correct, the case for willfull infringement would effectively been made.(IMHO)

SanDisk is halfway there. The Judge ordered Lexar to reveal the names of those who read and/or reviewed the "opinion." Now they need to see the opinion. That will be the next important decision.

By the way, and just as an aside, the patent counsel - Oppenheimer Wolff & Donnelly, LLP - they must be sweating. Hope they have a big malpractice policy. Good thing they are an LLP (Limited Liability Partnership).
