Head of the FTC spoke today and said they were going to be tougher on mergers. I think this is a factor in why JDSU did not go up today and that there was a significant increase in the spread between JDSU and ETEK.

He noted specifically that they would focus on industries where there were a lot of mergers and mergers between competitors. (Seems like the current state of FO to me.)

However, he also noted that mergers can increase cost-efficiencies, and this is good for consumers. (Also seems like the current state of FO to me.)

He spoke earlier in the day, but I saw him on CNN's Moneyline this evening.
