Well, if Bill Gate talked that Microsoft is willing to open up its source code for a settlement , I think a deal is already reached between DOJ and Microsoft. Just a matter of time to make an announcement. Open source code may not be a bad thing at all. With Millions of lines of codes, it will take the competitors years to figure out what is going on in the source code, and by that time the new product from Microsoft , which will not be open source code , will hit the market while the old window OS is obsolete. Besides , with open source code on Window OS, who is to buy Linux and Sunw's OS ?
