Hi CB, long time no see....

In your experience, do lawyers who are receiving a percentage of an award work faster than those who are billing on a per-hour (or tenth-of-an-hour, or whatever) basis? The latter would seem an incentive to work slowly.

Sorry, I yield to your expertise in time-division multiplexing. I once vetted a bill for a month's work from a partnership and found that on one day the senior partner had billed 26 hours. I demanded, without tipping my hand, a copy of his scheduler spread sheet. He refused. I told him I would take him to court for fraudulent overbilling. (This man is one of my best friends, but, as they say, business is business, and this was a non-profit tax exempt organization.)
He gave in and I was able to show him how he had made the mistake. He bought new software. We got a refund and a loyal (if slightly crooked) attorney. We call it "Strategic Lenity."
