Yes, that is correct.

I was in another company that I had a profit on during the period of the suit and I wasn't able to participate. I received the material about two months ago.

You can't sue unless you have a loss. I think the return on your loss for a company like THQI that has money and insurance etc.. (not a scam bb stock) is about 20% on the dollar, something in that range.

The factors they look at are the percentage of your loss. They receive the most. Anyone who purchased closer to the bottom receives a much smaller %. (i.e. the closer to the beginning of the claim get more)

I'm glad to see the suit. It pretty much guarantees certain shareholders some cash back IF they have a loss etc..

I bought the largest percentage of stock at $28 when they came out with that press release. I'm VERY disappointed in the company.

However, I'm not selling at a loss right now. I like their line-up this year and I've sold in positions like this and I was usually wrong. Cool heads generally prevail.

Earnings and plenty of info. on Wednesday.

P.S. Now that there is a suit against them, they really can't discuss certain things anymore can they... hmmmmm
