John Brown was tried for treason against the State of Virginia and executed under State authority, even though he seized a federal arsenal. Under U.S. he could not have been convicted of treason (only making war against the US or giving aid and comfort..). There was no federal law against murder at the time. There was no posse comitatus law at that time, so the use of federal troops to enforce state law could not be held to violate the 5th amendment guarantee. John Brown was not a citizen or subject of the Commonwealth of Virginia, and had no duty to it. He was innocent in the eyes of an avenging god and some learned attorneys. He could have been tried for felony murder and executed under state law.
