It is a lawsuit "WITH" AFFX. (Note the suits AFFX has brought against HYSQ) What I am saying is that AFFX and HYSQ are going to be involved in this lawsuit for awhile and that it is very costly. Having said this: "I wonder who has the deepest pockets?" This has been going on for three years already. HYSQ is already deeply in debt (since inception it never has been out of the red) and is looking for more money to borrow to pay legal fees and meet operating expenses. This hurts R&D.
