Thanks for the correction. The point is that most of the arguments that have been made by the msft law team since the beginning of the case were made so that they could bring these up on appeal. It was apparent very early in the trial process that the judge basically agreed with the DOJ on most if not all points. No doubt many of the arguments the DOJ has made and probably all of the arguments put forth yesterday were made for the express purpose of being able to use them on appeal. The judge will also be careful to craft his findings of law to minimize his chances of being overturned on appeal. It is my understanding that his findings of fact are simply a part of the record and only his findings of law are subject to appeal. He was basically able to say the way he saw the facts but he will have to be more careful with how he applies the law to these facts.
