Maybe, maybe not. In case you haven't been following closely, James, there's this odd little law that maybe allows DoJ to bypass the D.C. circuit and send any appeal directly to the Supreme Court. Which may be somewhat more hesitant than the D.C. Circuit to broadly throw antitrust law out the window, but who knows?

Then, there's the phrase that came up a lot after the FoF, Jackson had "poured a lot of concrete". I'm not a lawyer, but there is this other thing in the law about what can be appealed, factual findings at the trial level not being among them. It's just entertainment to me, though. Calling the Judge stupid is always considered good legal strategy, too.
