Uh, the assumption, on all sides, seems to be that the D.C. Circuit is predisposed to rule a certain way. No assumption is being made about the Supreme Court. There's a straightforward argument for going directly to the Supreme Court, it gets things resolved as quickly as possible, one way or the other. How does Microsoft argue against that? I wouldn't guess how the Supreme Court would rule myself, any more than I'd venture an opinion on the remedies issue.
