You are correct, that is a problem. There are reasons why war must be waged, but it should be as sparing of collateral damage to civilians as possible. However, the exigency is actually deeper, because conscripts are not exactly "guilty", which is why we have the Geneva Convention about the treatment of captured soldiers, and cannot simply execute them. War, in other words, is an occasional dreadful necessity that must be soberly waged, and avoided if possible......
