It's not first degree murder.

I'd have to check my copy of the state statutes to say more than that (I'm not a criminal defense attorney).

However, one thing we can say is: It was NOT the driver's INTENT to kill the child. Of that we can be sure.

In the case of abortion, however, it is ALWAYS the intent to kill the fetus. Has there ever been a case where a woman said "Yes, I intended to have an abortion, but I didn't know it would result in the fetus's death!".

Of course not.

The difference between driving drunk and having an abortion is: (1) Driving drunk is not intended to kill anyone; and (2) Having an abortion NECESSARILY results in the death of a fetus.

So what other gonadless arguments are you going to throw at me?
