Yahoo's profile of HYSQ (http://biz.yahoo.com/p/h/hysq.html) states they have a total of $32.7M is cash. Given my experience with patent litigation, I would not be overly concerned about having enough money to see this lawsuit through. A total out the door, end to end, ball park figure of say $4M comes to mind spread out over the course of the litigation - which means some already spent, and other dollars parcelled out over the course of the next year or so. I have a general familiarity with the CEO who used to practice patent law with a well regarded law firm in Chicago. With this as a backdrop and the addition of HYSQ's new Chairman, I suspect that raising cash or an alternative arrangement - contingency for example - may very easily be formulated.

Annie,
You're not concerned about how HYSQ pays for the lawsuit. You were looking for fodder to push your short bs. Since you know nothing about the science involved you attacked what little was available to you. Here we have a lawsuit that could ultimately be a windfall for HYSQ, and you're worried about how they are going to pay for it. It sort of like hitting the lottery and being concerned about whether you have bus fare to claim your prize.
