I wouldn't be surprised to see a flurry of private law suits upon the issuance of any final judgment against Microsoft, whether or not there's an appeal.

But that's JMHO, and not a legal opinion or investment advice.

Haven't you heard that the DOJ is considering invoking part of the Sherman Anti-Trust Act that will allow the case to be moved directly to the Supreme Court. The basis being exactly what you are saying that the problems are near term and not long term. Add to that that MS will be mired in civil suits as soon as the Judge Jackson renders his decision in the current phase. This means a pack of woes for MS near term. Don't forget the EU is also now on MSes case and the Anti-Trust laws in Europe are not stringent as US Law. In the US the test for for violation is not just a monopoly per se but "use of the monopoly power" to gain advantage in other businesses. In Europe all that has to be shown is that you are a monopoly.

The DOJ and Judge Jackson are coming down hard on MS to force them to settle. Judge Jackson reportedly is furious that MS had pulled out of the settlement talks. When you make a Judge angry one had better watch out. I am not a lawyer I just play one on "All About SUNW." <g>

Dear Rudedog: IMHO you are absolutely correct regarding class action attorneys and the like. They are a parasite on the land and totally out of control. Not only have they imposed a direct cost of doing business, which we the consumer pay for in the end, but they have imposed a tremendous restriction in new thoughts and ideas. Anyone who thinks they are in this to protect the public is TOTALLY naive. I have sat in and listened to their STRATEGY conferences and believe me what they are discussing is FEES not protection. JDN
