There are many precedents pertaining to contract law going back hundreds of years to the inception of laws and statutes governing business.

Although 90% of disputes are settled out of court, given the potential value of the contested interest, I see little prospect for an out of court settlement. Should Aber lose, I wouldn't be surprised if they appeal any decision all the way to the Supreme Court of Canada, no matter how tenuous the arguments. The lawyers are going to make a pile on this one:-))
