Mike, sorry, I must have misunderstood an earlier post. I thought they were going only for an injunction, when it appears that the injunction would RESULT from a favorable ruling on the partial summary judgment motion. They must have a good set of facts to be able to justify no need for a trial. It's worth recalling that in an earlier hearing, as reported by Eli, the court said it thought SNDK would prevail.
