There are a few things that come to mind when I think of VISX:
The company is fundamentally sound and has lots of cash. The company has lots of patents in an area where the dominant player will generate significant revenue.
They are under siege by quick buck artist, speculators, and attorneys trying to cash in on the potentials in the laser markets. Every manufacturer with a new laser has to find a way into that market, or die on the vine.
The near future for the company lies in the hands of the patent grantors. If the ITC positively rules for VISX next week, that will be the beginning of a turnaround
that will see a better share price evolve. If the US Patent Office reissues various basic patents in their favor, VISX (and Summit) will be the gatekeepers, and collect a royalty on just about every procedure performed in the USA.
Until this shakes out, we are all speculating as to the growth of this company.

This is a typical useless attempt to blackmail a company for making statements which are protected by the safeharbor provisions. Those Arkansas lawyers are really quite trustworthy, IMO.
