If the summary judgment motion is successful, it will mean that Lexar has to make some sort of settlement. If the matter goes to trial and Lexar is found guilty of intentionally infringing one or more patents, then they would have to pay not only actual damages, including legal fees, but also treble damages. Not a very good prospect for a company just about to go public! SNDK, after yesterday's announcement regarding Diamond Rio, has to be seen as the dominant company in solid state, non-volatile storage. The company should now be regarded as a long term hold, for at least the next five to ten years.
