Not always so in Federal cases such as this one is! Judges are usually not very nice in these cases either and I will bet that he will serve some time!

The US Attorney's Office for the Southern District of Texas has a very strong case against Tony, and the prosecutor may not have included sentencing recommendation as part of the negotiated plea disposition.

Besides, even assuming the prosecutor makes recommendations for lenient sentencing as part of the plea, the agreement is not binding on the presiding judge. No promises, predictions or guarantees are ever made by the prosecutor as to what penalty the presiding judge will choose to impose at time of final sentencing.
