Re default:

Without knowing the specifics of the manner of service or the law applicable to this jurisdiction, it is my experience that defaults are rarely entered if even the lamest explanation is offered as for the failure to file an answer.

It is also my experience that most courts take a very dim view of practitioners that rush to request entry of default.

I am not at all concerned that Tyco had not filed its answer.
