Right. What I am talking about is a firm that is not part of the "underwriting syndicate".

If you can get the shares to short from your broker, then you can short them. The only time you can't short them is if you are trying to borrow them from a member of the underwriting syndicate.

Additionally, if the broker is not a member of the underwriting syndicate or underwriting group,
they may not be bound by the prohibition...


Woudn't "in answer to your question" have been more appropriate?
