Papillon, all I can say is thank goodness for Homeowners insurance. Personal Liability coverage is a throw in on most policies and it covers you for defamation and libel, very helpful to have if you plan to say anything left of center about a company here on the Internet. My Homeowners insurance allowed me to stand firm and fight what I knew was clearly a SLAPP suit. The idea was not that, say, Business Wire thought I illegally used their trademark (heck, they affixed their trademark on the press release, not me!), it was that every added charge would take money to fight. The moment BW saw my insurance company was willing to fight until the end, that incentive disappeared and they asked to settle. Of course there was no way we were going to settle unless they dropped each and every charge, and no way we would agree to keep quiet about anything related to the lawsuit (normally parties agree to keep settlement talks confidential). So, BW dropped the charges and I wrote a detailed account of the events surrounding and leading up to it on SI:Message 12182423 In case anyone cares, here's an entire thread devoted to chat board lawsuits.
