PB,
I just listened to it again, "we think Intel violates anti-trust laws". Pretty strong words, if you were Intel legal would you allow that to be said by the ceo of a competitor?

Anyway, watching it again, I realized I failed to mention the GTW kiss ass on there too. Puke, "we think AMD can supply enough chips to satisfy demand". Yeah, no demand, no worries about supplying Athwipes(Engel TM).

Re: "Sanders is not a member of the press. I bet he can say it and get away with it. It's his opinion, and he has a right to free speech"

Free speech simply means the government can't shut you up. It does not give Jerry the right to make false and libelous statements without exposing himself to potential legal action to recover compensation for the damage he has caused to Intel's good name.

To defame someone in his business conduct is per se libel. That is, the plaintiff does not have to prove any damages to recover. The Times test does not apply, i.e. Intel is not a "public person" and actual malice need not be proved, although in this case it is self-evident. These words would also be interpreted as "unfair competition" in most states. Jerry was speaking as an official representation of AMD. The man is clearly nuts -- destroyed by hatred and malice. Intel should sue for libel and unfair competition. It should be able to collect huge damages. It can always use a couple more fabs.
