If memory serves me right, Microsoft strong armed Intel into licencing MMX instructions to AMD by threatening to withhold support for MMX in there OS and APs if they did not. The MMX name thing was just a screw up on Intel's part because they couldn't argue that MMX did not stand for "MultiMedia eXtentions" a descriptive that would be hard to protect. Bad news was Intel had a big ad campaign for MMX already in the can before they realized they couldn't protect the name.
