In the State of Florida, that would be considered a felony murder... it's a felony to point a gun and if someone dies during the commission of that felony, the charge is then felony murder even if the gun itself was not the direct cause of that death... the mere presense of the gun in that incident elevates the criminal risk to the individual pointing that gun if a person were to die inadvertently.....
