Dan,
There is a difference between patenting a gene vs a technique of manipulating a gene.
I believe the US patent office has awarded a number of gene manipulation patents.
Apparently they are not all bogus...
OTOH, without possible profit who's take the time to R&D gene therapies?
The human genome information itself is freely available on the internet. This needs to be readily available.
As far as patents, many universities hold patents in this area.
