Gerry, let me bring this off-topic discussion to an end (if possible) by agreeing with you. You seem to recognize that all that matters is the bias or opinion of the judge. Judges once thought that slavery was just fine, now they think it isn't. We try to keep judges who believe in slavery off of the bench, and usually succeed. Judges once thought that abortion was murder. Now one group tries to keep those who still believe this off the bench; others try to stuff the bench with those who believe this. Law is simply politics writ large. The important thing for people like you who want a limited government to ignore certain private behaviors is to infect the law schools with your doctrines.
Our little arguments will not effect jurisprudence. Mass market propaganda has no effect. Dred Scott died on the battlefield at Appomattox Courthouse, not in the courthouse itself.
