From reading the court docket (last entry on 3/7), it looked like Lexar was attempting to file a late brief in regard to the motion. SNDK objected and through today, no additional postings were on the docket. So I doubt there was any last minute witness. Generally, on motions, all the facts are presented to the court prior to the actual hearing. The hearing is reserved for attorney argument. Mike
