A story came out on Bloomberg this morning that U.S. antitrust enforcers are questioning whether JDSU's proposed acquisition of ETEK would hurt competition, said a customer and people familiar with the government's review.

Apparently Justice Department lawyers have interviewed customers of JDSU and ETEK.

Lucent acknowledged that it had been questioned by the Justice Department over the telephone. Lucent officials apparently "didn't take a formal position" on the combination.

JDSU's CFO, Anthony R. Muller, when asked if the company is concerned that the Justice Department would view the combination as increasing market concentration, apparently responded that "There are some very complex dynamics which we have described to the DOJ in our filing." Muller apparently added that customer interviews are a "very standard part" of an antitrust review.

According to the article, the DOJ has not formally issued a second request for additional information, though the 30 day period for the government to do so has not yet lapsed. Apparently the company doesn't know whether to expect such a request.
