This episode just illustrates how vulnerable shareholders are to outside interests and how ineffective the NASDAQ supervisors are in protecting investors from such incidence.
we still feel a halt in the stock until both parties had issued their statements would have prevented the large losses that some shareholders have incurred. Talk about buyer beware! This is simply a matter of no police around to protect an innocent walker on the street.
Having said the above-we admit that each investor must be savvy enough to realize that such legal claims can occur with any company and while we strongly agree with Mr. Threshie that the suit probably has no merit. Investors are not[or should not] be hand held when such events occur .They must live with their investment decisions and become sophisticated enough to do DD and make their own decisions.
We hope that TXMC will proceed quickly and vigorously in defence of this suit so that that problem is dispensed with and they can concentrate on the important matters of revenue and sales.Perhaps the SEC should investigate the unusual release of the suit PR late on Sunday.
