TRACKER: REVEALED! A lesson in two parts

Whoa! First, you are wrong, and I will prove it. But second, you resorted to personal insult: that was a mistake. So even though I am happily out of this stock since this morning (which ordinarily terminates my interest in posting here) you deserve this.

First let's remember where you are coming from. This is from this list in late February:

Your sources? Your sources? You're either leaking inside information, or dangerously puffing a company long ago proved hopeless. It's recruiting staff FOR WHAT? Your statement gives the impression that Tracker DOES something and it doesn't. It has NO operations. NO revenue. Nobody wants what it has.

"Beginning April" will be here very soon - and the credibility of your sources have exactly that long to redeem themselves.

But before I begin my real history lesson, let's look at another of your statements:

Incorrect.

Barcodes are an old way of tracking things. All Tracker owns a patent on a PARTICULAR SYSTEM of using them. Coming up with a non-infringing system is possible - in fact, somehow the entire world has been tracking inventory without Tracker's help. The only part of Tracker's (or any) patent that matters is the "claims" section - the part that details which part of its system the patent covers.

Okay, now let's look at Tracker's patent claims. Here's the URL to them:

There are 30 claims. The first thing I observe is EACH one is premised a "method for identifying PERSONAL possessions". That means that even if the patent cannot be easily gotten around by a non-infringing system, Tracker's patent has ZERO applicability to business. NONE! It doesn't even claim to - and at most it covers what is says it covers. It doesn't even mention the word Warranty. Ha!

Before we leave the patent, let's look at another of your statements about it:

> This was confirmed by their victory in a challenge in court.

Nope. The infringement case was AGAINST Tracker. The infringement case was dismissed. The press release saying so is dated May 20, 1999.

Maybe it means that the patent of the company that sued Tracker isn't very strong. But what does that mean about the strength of TRACKER's patent? NADA:

- At best, it means is that Tracker's activities - whatever it makes, uses, or sells, to use precise patent language - did not at the time of the lawsuit infringe the other company's patent. But Tracker doesn't make, use or sell a whole lot of anything.

- At worst, this lawsuit is bad news - it means there's two patents that cover different processes for achieving similar things - similar enough for their to be a jury trial about infringement. Or to be plainer: this suggests Tracker's patent isn't so easy to get around.

So in any event Tracker's victory does not say anything positive about its patent. Okay, enough with patents. Now let's get really educated. I'll continue this in my next post.

TRACKER REVEALED! Part two

This is a continuation of my last post. The mysterious two-named SAM-DAN accuses me of deliberately distorting facts. So I'm giving him some facts. At this stage in my lecture, we are looking at some history. Here's one of Tracker's press releases:

> The Tracker Corporation of America (OTC Bulletin Board: TRKR)
> today announced that in preparation for its U.S. launch, Tracker
> continues to add to its strategic alliance infrastructure within
> the crime prevention community in North America....
> "We are pleased to have added the police departments of the cities
> of Sacramento & San Jose, California, Boston, Massachusetts, Mobile,
> Alabama and Las Vegas, Nevada as part of our rapidly expanding
> network of scanning and recovery stations."
> Major announcements are expected as soon as The Tracker
> Corporation positions its recovery service in the U.S. marketplace.

Pretty inspiring stuff! Except for one thing: the press release was from April 12, 1995 - FIVE YEARS AGO. Is Tracker and its shareholders still pegging their hopes on its relations with police chiefs?!!!! How long are those hopes supposed to last? And today Tracker only talks about Florida - what's happened in Sacramento, Boston, Mobile and Las Vegas since 1995?

Here's another Tracker press release. This is from September 19, 1995:

> The Tracker Corporation of America today announced that
> it has entered into an Agreement with The L.L. Knickerbocker
> Company (Nasdaq: KNICD), to develop a custom site at CYBERTOWN,
> its worldwide web location. CYBERTOWN is an electronic virtual
> community of business and individuals coming together to engage
> in commerce and other activities on the Internet, which has
> over 20 million users in 154 countries, and is growing
> at a rate of 10-20% per month.

Well, I can't blame Tracker for that. 1995 was very early to be jumping on the internet bandwagon. If nothing else, it was hype with real insight. But now is nearly 5 years later: WHERE's THE MONEY?

There are other examples. For instance, in November 1999 Tracker announced "discussions" with Schwinn about an OEM application (and Schwinn has been an actual customer of Tracker's in the past). In January 8, 1998 Samsonite Company Stores, Inc. announced an agreement to actually sell Tracker's product. In January 22, 1998 Pet Assure Inc. announced a distribution agreement to include Tracker's pet recovery product. In December 9, 1998 Tracker announced an agreement with Sony Computer Entertainment America, Inc., a wholly-owned subsidiary of Sony Corporation. There was an agreement with Austin House in 1997 said to be worth $2million.

All very nice. Impressive, even. It makes me want to buy TRKR all over again.

But what does it mean? Only that Tracker's press releases don't mean any money. All come down to the fact that after pushing it's "leading technology" for 5 years, TRACKER'S TOTAL REVENUE FOR THE SIX MONTHS ENDING September 30, 1999 WAS $54,885 --- AND NO ZEROS ARE OMITTED FROM THAT. TRKR's optimistic presses release MEAN NO MONEY, and sooner or later that matters.

Time to get back to our fellow poster SAM-DAN regarding TRKR's most recent press release.

Incorrect.

Let's look at the entire guts of TRKR's press release and let people come to their own conclusions:

> July 15, 1999, Thursday
> The Tracker Corporation of America announced today that it has
> entered into a statewide partnership with Florida Police Chiefs
> Education and Research Foundation. Under the partnership,
> Tracker will install Tracker(TM) Systems in up to 1,000 Florida
> police departments and schools and train personnel in
> Operation Bicycle Identification. Tracker will open
> an office in Tampa, Florida to train personnel and coordinate
> the implementation of the program. Florida Police Chiefs
> Foundation will designate a member to sit on Tracker's Board
> of Directors.

I observe that it says PARTNERSHIP - this is a much abused word today, but legally it means sharing profits and sharing liabilities. But more to the point: the press release also says that Tracker WILL INSTALL- an absolute unqualified statement. There's nothing speculative about that - it doesn't say that "it will install systems IF it sells them".

> we feel the 20 million dollar estimate of revenue is underestimated by a multiple number.

Good luck.

In light of TRKR's history (and that's even leaving out its brush with the FTC with which it settled in 1997) you and all other TRKR shareholders need it.

Okay, boys, let's see if you're tuff enough to admit that I was a pretty sharp cookie in figuring out from day one that the "Florida Roll Out" was a failure. This was obvious to me from the moment it was announced.

Instead of "at least $20M" TRKR has taken in... zero.

I would call that a failure.

In this dimension, I mean.
